Tokenised Prepaid Mastercard® Terms and Conditions

 These Terms and Conditions apply to your Tokenised Prepaid Mastercard® (“the Card”). The card is issued by EML Payment Solutions Limited (ABN 30 131 436 532) AFSL 404131 (“EML”) pursuant to license by Mastercard Asia/Pacific Pte. Ltd. and distributed by TCN Group Pty Limited ABN 87 626 501 568 (“The Card Network”) or (“TCN”) on behalf of Any Store Gift Card Pty Ltd ABN 62056429504 EML has authorised The Card Network to arrange for the issue of the card. In these card terms and conditions, we, us or our means EML, The Card Network and Any Store Gift Card; and you, your or user means the cardholder.

When we refer to the Pays, we are referring to Apple Pay, Google Pay or Samsung Pay and further, when we refer to a Device, we are referring to a mobile or wearable device that allows you to store or otherwise add a Card to the Device.0

Pays availability is subject to your respective Card program sponsor and device capability. Although the Card is Pays enabled, availability of the Pays is contingent upon the card program you have signed-up for. In addition, Cardholders associated with Pays enabled programs must ensure their device is Pays capable. This means your device must have the ability to store the Card and actuate a purchase.

  1. You agree to be bound by these Terms and Conditions by utilising the Card in any capacity including but not limited to activating the Card, storing the Card into your Device, or using any Card features.
  2. The Card is a Mastercard prepaid card that can be used for purchasing goods and services where Mastercard prepaid cards are accepted for electronic transactions (excluding transactions at ATMs or over the counter at financial institutions).

  6. You acknowledge and agree that we do not provide you with paper Card transaction activity and balance information can be found by accessing the The Card Network App or your digital wallet. The Card is not reloadable. You are responsible for determining the available balance and ensuring the availability of sufficient funds for all transactions in the relevant currency.The Card cannot be used to make transactions that exceed the available balance. For such a transaction you need to pay the difference by another method if the merchant agrees.
  7. In the event the available amount on the Card is less than the purchase amount, some Merchants may not allow the Cardholder to combine multiple payment types (such as cash, check or another payment card) to complete the Transaction.
  8. The Card does not have cash out You may not use the Card to withdraw cash.
  9. The Card is valid until the expiry date shown within the The Card Network App and cannot be used after expiry. At expiry, the remaining available balance will be forfeited. We will not give you any notice before this happens.

  11. The Card cannot be used to obtain or redeem cash and cannot be used for making direct debit, recurring, or regular instalment payments. Use of the Card may be declined at some merchants (such as gambling merchants or merchants who choose not to accept the Card).
  12. We do not charge any fees for using the Card. However, to the extent permitted by law, some merchants may charge you for using the Card and such fees may be deducted from the balance of your Card at the time of the transaction.
  13. You are responsible for all transactions on the Card, except where there has been fraud or negligence by our staff or agents. If you notice any error relating to the Card, you should notify Any Store Gift Card Client Services immediately.
  14. You are responsible for checking your transaction history, knowing the available balance and date of expiry for the Card, all of which will be available to you on your Device by accessing the app.
  15. Except to the extent required by law, we are not liable for any loss or damage arising out of or in any way related to the use of the Cards, including:
    1. if authorisation is declined for any transaction, except where the authorisation has been declined because of an act or omission on our part;
    2. if you have other cards stored on your Device for payment and you inadvertently use the Card when using your Device as a payment method;
    3. for the use, functionality or availability of a Device;
    4. the availability of merchants who allow the use of the Device and Card as payment;
    5. reduced levels of service caused by the failure of third-party communications and network providers (except to the extent deemed liable under the ePayments Code); or
    6. if your Device security measures are compromised, you allow others access to your Device or to otherwise circumvent the security measures of your

  19. The digital Card is our We reserve the right, with or without notice and without incurring any liability to you to restrict, suspend or stop the use of the Card at our sole discretion, including without limitation if:
    1. we determine the Card has been used for an unlawful purpose;
    2. we determine suspicious activities have occurred;
    3. we discover you have breached these Terms and Conditions;
    4. you provide inaccurate, incomplete, false or deceptive information when applying for or using the Card.
  1. You agree to pay and authorise us to debit from your available balance all fees and charges listed in the Fees and Charges table below immediately as they are incurred.

 

Fees and Charges

All fees will be deducted directly from the available Card balance as set out below.

We do not charge any fees for using the Card. However, some merchants may charge you for using the Card and such fees may be deducted from the balance of your Card at the time of the transaction

  1. A 2.99% foreign exchange conversion fee applies to transactions in any currency other than Australian dollars and is calculated on the Australian dollar transaction This will be included in the total transaction amount debited to the Card.
  2. Any refunds on Card transactions are subject to the policy of the specific merchant. Refunds may be in the form of a credit to the Card, cash refund or in-store If the Card expires or is revoked before you have spent any funds resulting from a refund (whether or not the original transaction being refunded was made using the Card) then you will have no access to those funds.
  3. We may delay, suspend, block or terminate the processing of any transaction, without incurring any liability if we suspect the transaction:
    1. involves in any way illicit proceeds, illicit conduct or relates to an unlawful purpose;
    2. may be in breach of any laws and regulations in Australia or any other
  1. If we discover an error in the amount of funds loaded, reloaded, transferred, received or used for any reason, we are authorized to rectify the error without further notice to you, including but not limited to debiting the equal amount of funds found in error from your Cards available balance.

EFTPOS GIFT CARDS

Conditions of Use

Important information:

Please keep your gift card secure.  Your gift card is valid until the expiry date shown on the card.  It cannot be returned or exchanged for cash. No change is given. Any balance that remains on the gift card after expiry will be forfeited and will not be available for use. For further information and to check balances go to www.anystoregiftcard.com.au.

To use your gift card: Swipe the gift card. Select “Savings” and then enter the PIN on the back of the gift card.

Terms and conditions:  These conditions apply to your use of the Any Store Gift Card (gift card), issued by Technologica Pty Ltd ABN 62 056 429 504 (we, us, our). If you let another person use your gift card, you must tell them that they will be bound by these terms and conditions. Victorian law applies to these terms and conditions. By using your gift card you unconditionally submit to the jurisdiction of the courts of Victoria.

The gift card may be used to purchase goods or services at retailers in Australia with “EFTPOS facilities who accept the gift card, provided that the gift card has enough unused value to make the purchase, and has not expired. Some merchants may choose not to accept the gift card.

  1. Gift cards will be activated upon receipt of the gift card and cannot be redeemed for cash, reloaded, returned for a refund, have their balances consolidated to a new gift card, or be replaced after expiry and are not legal tender, account cards, debit or credit cards or securities.
  2. Keep your gift card secure – anyone holding the gift card can use its value to make purchases. If your gift card is lost or stolen, or you suspect an unauthorised transaction, immediately report this by calling 1300 785 506. We may be able to stop the gift card value being used, but require the card number, original balance and expiry date.
  3. We may replace a faulty, lost or stolen gift card. Any replacement gift card will have the same unused value (at the time of replacement) and the same expiry date as the original gift card. Call 1300 785 506 if you need to do this. You must have the reference number (located on the back of the gift card) and return the damaged card to us. We recommend that you make a record of the reference number and keep it separate from your gift card. Gift cards will be void if they are defaced, mutilated, altered or tampered with in any way. We may subject gift cards to verification and security checks in our absolute discretion. Fees and charges may apply to re-issue a card and replacements are done so at our discretion.
  4. If you have a query or complaint about the gift card, please raise it through any of our contact channels. We are not liable for the availability, quality or fitness for purpose of any goods or services purchased with the gift card. Any dispute about goods or services purchased with the gift card must be resolved with the supplier. Except for rights which cannot be excluded, any conditions or warranties implied or imposed by legislation or otherwise are excluded from these conditions of use. To the extent permitted by law, our liability is limited to replacing faulty gift cards.
  5. If you think there has been a mistaken transaction on your gift card contact the store where the mistake was made.

  7. We may cancel any gift card, or the gift card scheme for any reason at any time without notice. If so, we may either provide a refund or a replacement gift card of equivalent value unless we reasonably suspect fraud in relation to a gift card. The gift card remains our property.

We can vary or replace these conditions of use from time to time (including to introduce new fees) by publishing a notice on the website www.anystoregiftcard.com.au. The current version of these conditions of use is available through our website www.anystoregiftcard.com.au

  1. EXPIRY DATE: THE GIFT CARD WILL EXPIRE ON THE DATE SPECIFIED ON YOUR GIFT CARD. Check the expiry date on your gift card as soon as you receive it. After the gift card has expired, it is no longer valid. All transactions will be declined. Unused value will not be refunded and will become our property.

VISA GIFT CARD CONDITIONS OF USE
IMPORTANT: KEEP YOUR VISA CARD SECURE. LOST OR STOLEN VISA CARDS MAY NOT BE REPLACED OR REFUNDED. If your Visa Card is lost or stolen, we may be able to stop your Visa Card value from being used, but require the card number, original balance and expiry date.

GENERAL INFORMATION
These Conditions of Use govern the use and operation of your Visa gift card (“Visa Card”). Your Visa Card is issued to you by Indue Limited ABN 97 087 822 464 (“Indue”), at the request of Technologica Pty Ltd ABN 62 056 429 504 (“the Distributor”). Indue is an authorised deposit-taking institution and a member of Visa.By acquiring this Visa Card, you accept these Conditions of Use. If you give this Visa Card to someone else, you must tell them that by accepting the Visa Card, they will be accepting these Conditions of Use. In these Conditions of Use, “you” refers to the person who acquires the Visa Card, whether by purchasing the Visa Card or receiving the Visa Card as a gift, and “us”, “we” or “our” refers to Indue. The Distributor is the distributor and promoter of your Visa Card. The Distributor is also responsible for providing certain cardholder services to you. These services include providing you with your Visa Card, providing lost and stolen services and assisting you with any enquiries you may have regarding the use of your Visa Card.

INFORMATION ABOUT YOUR VISA CARD
Your Visa gift card is already active. Your Visa Card it can be used to make purchases and payments at EFTPOS devices, telephone and online, wherever Visa gift cards are accepted, if sufficient value is stored on your Visa Card. Your Visa Card cannot be used to withdraw cash at ATMs, redeem cash or be used to make direct debit or recurring or regular instalment payments. Such attempted unauthorised use may result in your Visa Card being suspended or cancelled and you may not be able to access any value remaining on the Visa Card. Some merchants may choose not to accept your Visa Card. You should always check with the merchant that it will accept your Visa Card before you attempt to purchase any goods or services. Merchants in the EU are prohibited from accepting certain anonymous gift cards (eg if the purchase amount or the face value of the gift card is above a certain amount). These regulations may change at any time, so you should check with EU merchants if they will accept the gift card. We may also exclude categories of merchants without notice for security or regulatory reasons. Your Visa Card is not reloadable. This means that additional funds cannot be added onto your Visa Card. Visa gift cards are not legal tender, credit cards, account cards, debit cards or securities. All Visa gift cards remain the property of Indue. To help prevent unauthorised use on your Visa Card, sign the back of your Visa Card after acquiring it.

USING YOUR VISA CARD
To redeem value by using your Visa Card:1.For EFTPOS transactions: swipe the Visa Card through the EFTPOS equipment, select CREDITand then enter your PIN code.2.For online and telephone transactions, enter the card number, expiry date and ccv number. Your PIN code can be obtained by referring to the scratch panel on the back of the card. You do not need to use the whole Visa Card value in one transaction. Before using your Visa Card, check the balance of your Visa Card online atwww.anystoregiftcard.com.au. You should ensure there is sufficient value available on your Visa Card for the cost of the purchase plus any fees that may apply (refer to “Fees” section below). Change will not be given by merchants for purchases using your Visa Card. You cannot make transactions that exceed the available balance of your Visa Card. You must check with the merchant if and how you can make a purchase that exceeds the available balance by paying for the difference using other means. Merchants may impose their own restrictions on the use of your Visa Card, such as minimum payment amounts.All transactions conducted overseas will be converted into Australian dollars. Transactions will either be converted directly into Australian dollars or will be first converted from the currency in which the transaction was made into US dollars and then converted to Australian dollars by Visa Worldwide PTE Ltd (“Visa”). The conversion rate used is either:•a wholesale market rate selected by Visa from the range of wholesale rates available in wholesale currency markets for the applicable processing date, which may vary from the rate Visa receives; or the government-mandated rate in effect for the applicable processing date. You must not use your Visa Card for any unlawful purpose, including the purchase of goods or services prohibited by the laws of Australia and/or the laws of the location where the Visa Card is used or where the goods or services are provided. Should your Visa Card be used for unlawful purposes, your Visa Card may be suspended or cancelled and you may not be able to access any value remaining on your Visa Card.

FEES
The following standard fees and charges apply. You agree to pay to Indue all fees and charges that are set below in this section. Indue will deduct these fees and charges from your Visa Card by debiting (deducting) the amount of the fee and charge as specified below. All fees and charges are inclusive of GST.If you consider that Indue has incorrectly charged you a fee or charge, you may dispute this by contacting the Distributor in the first instance. Any incorrectly charged fee or charge will be reversed by Indue.

Currency Conversion Fee: 3.5% of the total amount of each transaction, payable and deducted from your Visa Card at the same time you make a transaction on your Visa Card account in a currency other than Australian dollars, or you make a transaction on your Visa Card in any currency (including AUD) that is processed by a card scheme or billed by the merchant outside of Australia. 1.0% of the total amount of each such transaction is payable to Visa as a currency conversion charge and the remaining 2.5% of the total amount of each such transaction is an administration fee payable to Indue. This fee includes an amount payable by us to Visa. The fee is a percentage of the converted AUD amount of the transaction.”

EXPIRY
Your Visa Card will expire on the date shown on the front of your Visa Card. On the expiry of your Visa Card, any balance that remains after the expiry date will not be available for use and will be forfeited by you and become the property of the Distributor.

LOSS OR THEFT OF YOUR VISA CARD
Ensure you keep your Visa Card secure. Anyone holding the Visa Card can use its value to make purchases. You are responsible for all transactions on your Visa Card, except those that are as a result of Indue or the Distributor’s employees or agent’s fraud or negligence. If your Visa Card is lost or stolen, or you suspect an unauthorised transaction, immediately report this to the Distributor by email, [email protected] or calling 1300 785 506. We may (at our discretion) replace a faulty, lost or stolen Visa Card. A tiered fee system commencing from $17 applies. DISPUTES AND ENQUIRIES
If you have any enquiries or complaints in relation to your Visa Card, you should, in the first instance, contact the Distributor. If you cannot resolve the complaint with the Distributor, you should contact Indue. The contact details for the Distributor and Indue are set out below. We have the ability in certain circumstances to investigate disputed transactions which occur on your Visa Card and attempt to obtain a refund for you. In accordance with the Visa scheme rules, our ability to investigate a disputed transaction on your behalf is limited to the time frames imposed pursuant to the Visa scheme rules. The maximum time frames vary between 75 days and 120 days so it is important that you notify us as soon as you become aware of a disputed transaction.

OTHER GENERAL CONDITIONS
Indue may assign its rights or transfer these Conditions of Use to another person where such assignment is to a related party or third party where such third party has similar or more fair dispute resolution procedures than Indue. If Indue transfers or assigns the rights under these Conditions of Use, it will provide you with at least 60 days notice on the website www.anystoregiftcard.com.au. These Conditions of Use will apply to the transferee or assignee as if it were named as Indue.

We may only change, add to or delete the terms and conditions set out in these Conditions of Use if we provide you with at least 30 days notice of the change or variation. Such changes will be published on www.anystoregiftcard.com.au. We may only change these terms and conditions in a way that materially reduces or limits your rights under these terms and conditions if we are required to do so by law, where such changes are imposed on us by third party providers (including Visa) or where the change is required to protect our legitimate commercial interests.If you provide personal information to Indue, you consent to Indue disclosing your personal information to third parties that (a) facilitate transaction investigation and assist with identification of suspicious or fraudulent transactions; (b) are our outsourced service providers (for example, data switches); (c) are regulatory bodies, government agencies, law enforcement bodies and courts; and (d) are participants in the payment system and other financial institutions for the purpose of resolving disputes, errors or other matters arising from your use of your Visa Card. For details on how you may access and seek correction of any personal information Indue holds about you, please refer to Indue’s Privacy Policy available at www.indue.com.au. This contains details on how Indue deals with any personal information it collects in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. For details on how you may complain about a breach of the Australian Privacy Principles and how Indue deals with complaints, please refer to the Privacy Policy.
